ECCS Labs — User Agreement (Terms of Service)

This User Agreement ("Agreement") is entered into by and between ECCS Labs ("Company," "we," "us," or "our") and the individual or entity accessing or using the Services ("User," "you," or "your"). This Agreement governs access to and use of all ECCS Labs websites, applications, devices, APIs, dashboards, IoT systems, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by this Agreement.

1. Description of Services

  1. The Company provides an Ethical Content Curation System (ECCS), a personalization platform utilizing multi-dimensional AI-based scoring models.
  2. The system may evaluate content across dimensions including Tone, Bias Balance™, Intent, Emotion, Depth, Relevance, and Ethical Integrity™.
  3. The Services may generate curated Ethical Feed™ outputs, provide Explainability Map™ visualizations, enable configuration through Tone Tuner™, and operate across cloud, edge, and IoT environments.
  4. The Services are designed to promote user agency, personalization transparency, and media literacy.

2. Eligibility

  1. You must be at least eighteen (18) years of age or the age of digital consent in your jurisdiction to independently use the Services.
  2. If under such age, usage must occur under parental, guardian, or institutional supervision where required by law.
  3. Separate enterprise or regulated agreements may apply for educational or regulated deployments.

3. User Accounts

  1. Certain features require account registration and accurate submission of information.
  2. You are responsible for maintaining confidentiality of login credentials and for all activities conducted under your account.
  3. The Company reserves the right to suspend or terminate accounts for violations of this Agreement.

4. AI Scoring and Content Disclaimer

  1. AI-generated scores are probabilistic and do not constitute definitive assessments.
  2. Bias Balance™ does not guarantee ideological neutrality or completeness of viewpoints.
  3. Ethical Integrity™ reflects model-based interpretation and is not a moral or legal determination.
  4. The Company does not guarantee factual accuracy of third-party content and disclaims responsibility for user interpretation.

5. User-Generated Content

  1. By submitting content, you grant the Company a non-exclusive, worldwide, royalty-free license to process, analyze, store, and display such content.
  2. You represent and warrant that you possess all rights necessary to submit such content.
  3. The Company may remove content that violates law, third-party rights, or platform policies.

6. Preset Marketplace™

  1. Users may create and publish Tone Tuner™ configurations.
  2. By publishing presets, you grant the Company rights to display, distribute, and recommend such presets.
  3. The Company reserves the right to remove presets that violate policy or law.

7. Digital Diet™ Analytics

  1. The Services may generate analytics based on user interaction data.
  2. Analytics may be used to improve personalization and system functionality in accordance with the Privacy Policy.

8. IoT and Edge Systems

  1. Certain Services may operate on IoT Wearables, Classroom Hubs, and Edge Nodes.
  2. Offline content may reflect cached scoring states.
  3. Users acknowledge responsibility for maintaining device security.

9. Acceptable Use

  1. You shall not reverse engineer, decompile, or attempt to extract proprietary system logic.
  2. You shall not misuse APIs or attempt to circumvent guardrails or scoring protections.
  3. Enterprise users must comply with contractual rate limits and licensing terms.

10. Intellectual Property

  1. All proprietary systems including Content Mood Matrix™, Ethical Feed™, Explainability Map™, Tone Tuner™, and related technologies are owned by ECCS Labs.
  2. Such systems may be protected by patent, trademark, and trade secret law.
  3. No rights are granted except as expressly stated in this Agreement.

11. Professional Disclaimer

  1. The Services do not provide medical, legal, financial, or professional advice.
  2. Users must consult qualified professionals for professional guidance.

12. Limitation of Liability

  1. To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, or consequential damages.
  2. Total liability shall not exceed amounts paid by the User in the preceding twelve (12) months.

13. Indemnification

  1. You agree to indemnify and hold harmless the Company from claims arising out of misuse, submitted content, or violations of law.

14. Governing Law and Dispute Resolution

  1. This Agreement shall be governed by the laws of the State of New Jersey, United States.
  2. Disputes shall be resolved through binding arbitration where permitted by law.

15. Modifications

  1. The Company may update this Agreement at its discretion.
  2. Continued use of the Services constitutes acceptance of modifications.
